The Wheaton Courthouse is located at 505 County Farm Road in Wheaton, right next to the DuPage county jail and just west of the DuPage County Fairgrounds. At this main DuPage County Courthouse, there is free parking located around the building, including a covered parking garage just behind the facility. Many kinds of cases are heard at the Wheaton Courthouse Including various ordinance violations, misdemeanors and felonies. Make sure to allow sufficient time to wait in line to go through the metal detectors and still get to your courtroom a little early.

SEXNER’S PRO LEGAL TIP: It has been said that video evidence can “make you” or “break you”. Say that you have been arrested for a DUI. If there is a video of you driving your car (as there often is from the police squad’s dash cam) or video of you performing the Field Sobriety Tests (FSTs) from the dash cam or a police body cam, what is on the video may mean the difference between a finding of not guilty or the loss of your license. Similarly, if you’ve been arrested for a retail theft, most major department stores have video virtually everywhere (except the bathroom and the changing rooms) and what the video discloses may mean the difference between jail or freedom.

Now once upon a time, there was no video – and it’s definitely true that there are still many, many cases where no video exists as evidence. Some refer to these cases as “he said/she said” cases because one person (the defendant) says one thing and the other person (the police or a victim) say another. A judge then needs to determine who is telling the truth and whether the accused has been proven guilty beyond a reasonable doubt. These kinds of cases can go either way as judges are not mind-readers or human lie-detectors.

But when there is video (or audio or a social media image), that’s another story. If these items are allowed into evidence during a trial, then a judge will be able to view them. -And although it’s one thing to believe the words of a person, it’s entirely another thing to trust your own eyes. Judges trust their own eyes. So, if the video looks bad for a defendant, then you should expect that the trial result will likely be bad. Whereas if it appears from the video that they did not in fact commit a crime or traffic offense, then that’s certainly a very good sign.
